Custody Committee in Dubai Courts Established by Maktoum bin Mohammed

His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai and President of the Judicial Council of Dubai, issued Decision No. (7) of 2022 establishing the Custody Committee, part of the Dubai Courts.

The new legislation is part of the Dubai government’s commitment to ensure the welfare and protection of children affected by custody conflicts and to protect their physical and mental well-being.

According to the Decision, the Custody Committee will consist of two representatives from the Dubai Courts, appointed by the Director General of the Dubai Courts, who will serve as Chairman and Deputy Chairman of the Committee, and two representatives from the Dubai Community Development Authority, appointed by the Director General of the Authority, one of whom will be from its Child Protection Unit. The Committee will also include two representatives from the Dubai Police, specialising in child protection, appointed by the Dubai Police Commander-in-Chief, and a member of the Dubai Courts, who will act as the Committee’s rapporteur.

The Custody Committee is mandated to prepare a detailed report on the social, mental, medical and criminal status of the person requesting custody or the person to whom the court will grant custody of the child.

The decision also sets out the procedures for preparing a guardianship eligibility report. The court will first ask the Custody Committee to prepare a guardianship eligibility report, after which an on-site visit will take place to ensure that the child’s guardian or custodian is suitable to take care of the child, in addition to assessing other requirements.

The decision obliges the relevant authorities in Dubai responsible for children to cooperate fully with the Committee and provide all information and data requested by it to fulfil its duties. The decision shall enter into force on the date of its publication in the Official Gazette.
